Legal guarantee

• If a product purchased on the www.monge.ge platform is found to be defective, the consumer has the right to request www.monge.ge to eliminate the defect (replace or repair the product free of charge, reduce the price) or withdraw from the contract;
• Replacement or repair of the product is the first-line right of the consumer. The consumer has the right to request www.monge.ge to repair or replace the product free of charge, unless this is impossible due to the nature of the product or would require disproportionate or unreasonable costs;
• The product must be repaired or replaced within a reasonable period of time Tbilisi and its surroundings 5 (five) calendar days in other cases 14 (fourteen) calendar days, without causing the consumer significant disruption, taking into account the nature of the product and the purpose for which he purchased it;
• Free replacement or repair of the product implies that www.monge.ge will bear all costs necessary to ensure compliance of the product with the terms and conditions stipulated in the contract;
• The consumer has the right to request a reduction in the price of the product or to withdraw from the contract if one of the following conditions exists:

• The product cannot be repaired or replaced;
• www.monge.ge did not replace or repair the product within a reasonable time and the consumer lost interest in the performance of the contract;
• Replacing or repairing a product by www.monge.ge will cause significant inconvenience to the customer.

In the event of withdrawal from the contract, the consumer has the right to demand compensation for damages caused by non-fulfillment of the contract in accordance with the procedure established by the legislation of Georgia;

The consumer does not have the right to withdraw from the contract if the defect in the product is minor;

The consumer has the right to exercise the above-mentioned rights if the defect in the goods is discovered within 24 hours of the goods being delivered to him/her;

If the consumer discovers a defect in the product within 24 hours of receiving it into his possession, it is presumed, until proven otherwise, that the defect existed at the time of delivery of the product, if this is possible due to the nature of the product or the nature of the defect. In this case, the burden of proof lies with www.monge.ge. If the consumer discovers a defect in the product after 24 hours of receiving it into his possession, the burden of proof that the defect existed at the time of delivery of the product lies with the consumer;

The legal warranty does not apply to the purchase of a secondary product. In the case of the purchase of such a product, the liability of www.monge.ge in the above-mentioned cases is the subject of an individual agreement between the parties.

Legal warranty service is not provided or is canceled if:

• The product warranty period has expired;
• The consumer cannot present a warranty document and the product cannot otherwise be identified;
• Information on the warranty document has been deleted or altered and the product cannot otherwise be identified;
• The data on the sold product has been deleted, changed, or modified, the serial number is not readable/marked on the product, and the product cannot otherwise be identified;
• The damage is caused by damage to the packaging or bundle;
• The damage is caused by physical impact and improper operation;
• Damage caused by lightning, ingress of foreign bodies and liquids, violation of operating and storage conditions;
• Installation or repair work was carried out by other third parties, which caused damage to the product;
• The purchased products were used for commercial and entrepreneurial purposes.

Warranty service is not provided if insurmountable conditions arise in the country due to force majeure.
